Acceptance of Terms
By accessing or using Really Real Work, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Really Real Work, Inc. We reserve the right to modify these Terms at any time, and your continued use of the Service following any changes constitutes your acceptance of the revised Terms.
If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms. In such cases, "you" and "your" will refer to that organization.
Description of Service
Really Real Work provides an AI-powered image enhancement platform designed specifically for real estate professionals. Our Service allows users to upload property photographs and apply various AI enhancements, including image quality improvement, virtual staging, object removal, sky replacement, and other transformations. The Service is delivered through our web-based platform and may include additional features over time.
We continually evolve and improve our Service. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes that may affect their use of the platform.
Account Registration
To access certain features of the Service, you must create an account. You must be at least 18 years of age to register for an account and use our Service. By creating an account, you represent that you are at least 18 years old and that all information you provide during registration is accurate, current, and complete.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that contain inaccurate information or that we reasonably believe have been compromised.
User Content & Image Rights
You retain full ownership of all images and content you upload to Really Real Work ("User Content"). By uploading images to our platform, you grant us a limited, non-exclusive, royalty-free license to use, process, store, and transmit your images solely for the purpose of providing the Service to you. This license includes the right to send your images to our AI processing partners for enhancement purposes.
You represent and warrant that you own or have the necessary rights, licenses, and permissions to upload and process all images you submit to the Service. You further represent that your User Content does not violate any third party's intellectual property rights, privacy rights, or any applicable laws. You are solely responsible for ensuring that you have proper authorization to use and process any images uploaded to our platform.
Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Upload or process any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
- Use the Service to create fraudulent or misleading real estate listings
- Attempt to reverse-engineer, decompile, or extract the source code of our AI models or algorithms
- Use automated tools, bots, or scripts to access the Service in a manner that exceeds reasonable usage
- Circumvent any rate limits, access controls, or security measures of the Service
- Share your account credentials or allow unauthorized access to your account
- Use the Service to process images that contain illegal content or violate any person's rights
- Resell or redistribute the Service without our prior written consent
AI Processing Disclaimer
Really Real Work uses artificial intelligence and machine learning technologies to enhance and modify images. While we strive to deliver high-quality results, the output of AI processing is inherently variable and may not always meet your expectations. We do not guarantee specific results, accuracy, or quality of any AI-generated enhancements.
AI-enhanced images may contain artifacts, distortions, or inaccuracies. You are responsible for reviewing all processed images before using them in any professional or commercial context. AI Image Studio shall not be held liable for any consequences arising from the use of AI-enhanced images, including but not limited to inaccurate property representations in real estate listings.
Virtual staging and object removal features are intended for visualization purposes only. Any modifications made to property images should be clearly disclosed to prospective buyers or renters in accordance with applicable real estate advertising laws and regulations.
Payment Terms
Really Real Work offers both free and paid subscription plans. The free tier provides limited access to our core features, while paid plans offer expanded capabilities, higher processing limits, and premium features. Details of current plans and pricing are available on our pricing page.
Paid subscriptions are billed on a recurring basis (monthly or annually, as selected). Payment is processed through Stripe, our third-party payment processor. By subscribing to a paid plan, you authorize us to charge your payment method on each billing cycle. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. We do not offer refunds for partial billing periods.
Intellectual Property
The Service, including its original content, features, functionality, design, and underlying technology, is owned by Really Real Work, Inc. and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks, logos, and service marks may not be used in connection with any product or service without our prior written consent.
Nothing in these Terms transfers any intellectual property rights from us to you, except for the limited license to use the Service as described herein. Any feedback, suggestions, or recommendations you provide regarding the Service may be used by us without any obligation to compensate you.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, REALLY REAL WORK, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100). This limitation applies regardless of the theory of liability, whether based on warranty, contract, tort, or any other legal theory.
Termination
You may terminate your account at any time by contacting us or using the account deletion feature in your settings. We may suspend or terminate your access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.
Upon termination, your right to use the Service will immediately cease. We will retain your data for a reasonable period to allow you to retrieve your content, after which it will be deleted in accordance with our data retention policies described in our Privacy Policy. Any provisions of these Terms that by their nature should survive termination shall continue to apply.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in San Francisco County, California, and you hereby consent to the personal jurisdiction of such courts.
Any dispute arising from these Terms that cannot be resolved through informal negotiation shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in San Francisco, California.
